Today, the National Institute of Statistics and Geography (INEGI) announced the updated value of the Unit of Measure and Update for 2024, experiencing a 4.66% increase compared to 2023, reaching $108.57 per day.

This increase will take effect starting February 1, 2024, and will also have an impact on labor penalties related to non-compliance with year-end bonus payments, profit-sharing, working hours, vacation premium payments, and compliance with occupational health and safety standards. These penalties arise from labor inspections conducted by the Ministry of Labor and Social Welfare, which are carried out each year in increasing numbers and with greater stringency by labor authorities.

It is noteworthy that the current highest fine stipulated in the Federal Labor Law is related to outsourcing. Employers who violate regulations in this regard may be subject to fines of up to $5,428,500.00. However, the Ministry of Labor and Social Welfare can set the fine on an individual basis for each worker deemed affected, resulting in significant fines for the business sector.

Here are some examples of how penalties for 2024, resulting from inspections conducted by the Ministry of Labor and Social Welfare, will be determined:

  1. Committing or tolerating discrimination or harassment: between $271,425.0 and $542,850
  2. Failure to pay year-end bonuses: between $5,428.50 and $542,850
  3. Obstruct or not facilitate a Labor Ministry inspection: between $271,425.0 and $542,850
  4. Non-compliance with subcontracting rules: between $271,425.0 and $5,428,500.0

In addition to this, if a single act results in various violations, the fine is imposed for each proven inconsistency independently.
